Pacquiao brod is disqualified from congressional run due to residence

A petition for the disqualification of Rogelio "Ruel" Pacquiao due to lack of residency was filed by rival Megie "Jamby" Ramos-Orig at the Comelec main office on 26 April 2016.

Disqualification case filed vs Pacquiao
A disqualification case was filed Tuesday against Sarangani Lone District candidate for House of Representatives Rogelio Pacquiao, brother of boxing champ Manny Pacquiao who is also a senatorial candidate this coming May 9 polls.
The Petition for Outright Disqualification with Motion to Suspend Proclamation was filed before the Commission on Election (Comelec) by Megie "Jamby" Ramos-Orig, a resident of the Municipality of Kiamba and who is also a candidate for the lone seat for House of Representatives in Sarangani Province.
Ramos-Orig in her petition represented by Atty. Bertenie Cataluna Causing, noted that Pacquiao has not met the required one-year residency to run for congressman in the district of Sarangani.
Causing argued that the Comelec has jurisdiction to entertain and give due course to their petition as laid down under the Commission's Rule 25 which "merely implements that Constitutional provision prohibiting persons to serve as a member of the House of Representatives if one year counted back from the day of election the candidate has not resided for at least one year in the district he or she seeks to be elected."
Causing added that it is also in the records of the Comelec, particularly General Santos City Comelec, that Rogelio D. Pacquiao filed his certificate of candidacy for barangay chairman of Barangay Apopong in General Santos City in 2013, and subsequently won and proclaimed by Comelec and swore into office by the Department of the Interior and Local Government (DILG) as chairman of Barangay Apopong.
"Until now, there is no proof that Rogelio D. Pacquao resigned from being the barangay chairman of Apopong one year earlier than the day of election, an act that he should do in order to show proof that he voluntarily disqualified himself to be the chairman of the same barangay by means of relinquishing his residency therein in favor of a new place of resident," the petitioners said in their motion.
However, a resignation letter of Pacquiao obtained by the petitioners showed that it was dated and filed on 30 October 2015, the earliest possible date that he can only be considered as having relinquished his residency from Barangay Appopong, General Santos City.
Causing said it must also be noted that during the time Pacquiao filed his COC as candidate for Congressman for the Lone District of Sarangani he is still a Barangay Captain of Barangay Apopong in General Santos City and his continued acts as Apopong Village Chairman would contradict the argument on domicile.
He added that another record of lack of proof of sufficient residency on the part of Pacquiao is the fact that the deed of absolute sale in his favor in buying of a residential property located at Lot 24, Block 2, Alpha Village, Barangay Poblacion, Alabel, Sarangani, has no records that it was notarized on the date at least one-year prior to the date of election of 9 May 2016.
"If a proof is furnished that the candidate failed to satisfy the requirement of residence of one year immediately preceding the day of election, he is automatically disqualified and the Comelec will declare outright his or candidacy to be considered as NULL and VOID," the petition asked the Commission.
Causing also moved that in case Pacquiao wins as a result of the counting and canvassing of votes, his proclamation be suspended "if only not to spoil all the official acts that may have been done if only there was no serious issue in the qualification of Pacquiao.

Petition for Disqualification

The petitioner, by the undersigned counsel, respectfully files this Petition for Disqualification seeking the disqualification of ROGELIO D. PACQUIAO from running as a candidate for the lone seat of House of Representative for the Lone District of Sarangani Province.

The Timeliness

(1) Under Section 3, Rule 25 of the COMELEC Rules of Procedure, it says that at any time before proclamation any petition for disqualification of a candidate may be filed by any citizen or registered voter, who should be one that is a voter in the district where the candidate sought to be disqualified is running for election.
(2) The instant petition is being filed when what was at hand was a campaign period.
(3) Hence, the instant petition is timely.

Jurisdiction of the Comelec

(4) The Commission on Elections (Comelec) has jurisdiction to entertain and give due course to this petition as laid down under Rule 25.
(5) Rule 25 merely implements that Constitutional provision prohibiting persons to serve as a member of the House of Representatives if one year counted back from the day of election the candidate has not resided for at least one year in the district he or she seeks to be elected.
(6) In the 1987 constitution of the Republic of the Philippines, Sec. 6, Article VI mandates:
“SECTION 6, No person shall be a member of the House of Representative unless he is a natural-born –citizen of the Philippines and, on the day of the election, is at least twenty five years of age, able to read and write, and except the party-list representatives, a registered voter in the district in which he shall be elected, and a resident thereof, for a period of not less than one year immediately preceding the day of the election” Underscore provided.
(7) Hence, together with the Constitutional provision that vests unto the Comelec the exclusive power to promulgate its own rules of procedure, there is now no question that the Comelec has jurisdiction to entertain and act on the instant Petition for Disqualification.

The Parties

(8) The petitioner is MEGIE “JAMBY” RAMOS-ORIG, who is a resident of the lone district of Sarangani Province and who is now officially a candidate for the lone seat for House of Representatives in Sarangani Province.
(9) The petitioner is more than qualified to run for election for the Province of Sarangani’s lone seat of membership in the House of Representatives.
(10) The petitioner is a resident of the Municipality of Kiamba and is a registered voter at Precinct 0012A in the Poblacion of Kiamba.
(11) For purposes of clarity, convenience and propriety, it is requested that all notices intended for the petitioner be addressed to this counsel at his address written below.
(12) The respondent is ROGELIO D. PACQUIAO, who also filed a certificate of candidacy for the same lone district’s seat for House of Representatives.
(13) ROGELIO D. PACQUIAO may be sent summons, subpoenas or notices at the address he represented as Lot 24, Block 2, Alpha Village, Brgy. Poblacion, Alabel, Sarangani Province.
(14) It is therefore requested that the summons or order requiring him to answer the instant petition for disqualification be addressed to the same address stated in the immediately preceding paragraph.

The Cause of Action

(15) Section 6 of Article VI of the Constitution states:
“SECTION 6, No person shall be a member of the House of Representative unless he is a natural-born –citizen of the Philippines and, on the day of the election, is at least twenty five years of age, able to read and write, and except the party-list representatives, a registered voter in the district in which he shall be elected, and a resident thereof, for a period of not less than one year immediately preceding the day of the election” Underscore provided.
(16) It is very elementary that the period of residence of one year in the district where the candidate seeks to be elected is a substantial and jurisdictional requirement for one person to perform the duties of a member of the House of Representatives.
(17) If a proof is furnished that the candidate failed to satisfy the requirement of residence of one year immediately preceding the day of election, he is automatically disqualified and the Comelec will declare outright his or candidacy to be considered as NULL and VOID.
(18) One of the pieces of evidence of the petitioner to prove that Rogelio D. Pacquiao lacks residency is the fact that the burden of proof of sufficiency in residency period rests on the shoulder of Rogelio D. Pacquiao.
(19) It is in the records of the Commission on Elections, particularly General Santos City Comelec, that Rogelio D. Pacquiao filed his certificate of candidacy for barangay chairman of Barangay Apopong in General Santos City in 2013.
(20) It is also a judicial notice for the Comelec to know that Rogelio D. Pacquiao won in the election for chairmanship of Barangay Apopong that he was subsequently proclaimed as winner by the Comelec and that he swore into office and had entered the office, which information also within the judicial notice of the Department of the Interior and Local Government (DILG).
(21) Until now, there is no proof that Rogelio D. Pacquao resigned from being the barangay chairman of Apopong one year earlier than the day of election, an act that he should do in order to show proof that he voluntarily disqualified himself to be the chairman of the same barangay by means of relinquishing his residency therein in favor of a new place of resident.
(22) To the contrary, there is a proof that Rogelio D. Pacquiao lacks residency of one year and this proof consists of his IRREVOCABLE RESIGNATION LETTER EFFECTIVE THE DATE OF THE RESIGNATION LETER.
(23) The resignation letter of Rogelio D. Pacquiao shows that it was dated and filed on 30 October 2015, the earliest possible date that he can only be considered as having relinquished his residency from Barangay Appopong, General Santos City.
(24) A copy of the resignation letter is attached hereto as ANNEX “A.”
(25) Another record of lack of proof of sufficient residency on the part of Rogelio is the fact that the deed of absolute sale in his favor in the buying of a residential property located at Lot 24, Block 2, Alpha Village, Barangay Poblacion, Alabel, Sarangani, has no records that it was notarized on the date at least one-year prior to the date of election of 9 May 2016.
(26) Mr. Pacquiao made it appear that he purchased the same property on 8 August 2014 in a Deed of Absolute Sale that was allegedly notarized by Atty. Tomas C. Falgui II.
(27) A copy of the alleged Deed of Absolute Sale is attached hereto as ANNEX “B” as certified to by the Registry of Deeds of Sarangani and showing that it was so notarized by Atty. Tomas C. Falgui II as Doc. No. 106, Page No. 22, Book No. CDVI, Series of 2014, dated 8 August 2014.
(28) What lost the supposed presumption of regularity in the alleged Deed of Absolute Sale is the fact that the Clerk of Court of the Regional Trial Court of General Santos City, Atty. Gerardine A. Jamora-Gayola, certified that Atty. Tomas C. Falgui II has not yet submitted his notarial documents from August 6, 2014 up to the present.
(29) A copy of the Certification of the Office of the Clerk of Court of the RTC of General Santos City where Atty. Tomas C. Falgui II was commissioned as a notary public is attached hereto as ANNEX “C.”
(30) Now, as it appears, what support the theory that the said Deed of Absolute sale as a falsification as to the date of execution are the facts that the resignation letter was done only on 30 October 2015, that the registration of the sale and the issuance of the Certificate Authorizing the Registration (CAR) were made only on September 10, 2015 at the Bureau of Internal Revenue.
(31) A copy of the registration of the sale is attached hereto a ANNEX “D”.
(32) A copy of the Certificate Authorizing the Registration is attached hereto as ANNEX “E.”
(33) September 10, 2015 is only a month before filing his Certificate of Candidacy (COC) on October 12, 2015.
(34) A genuine concern or acts for the purpose of changing residency must have be shown to have been down more than one year prior the day of election.
(35) In this case, all those documents evidencing transfer of residence must have been dated at the latest on 8 May 2016.
(36) The fact that all documents or instruments evidencing transfer of residence are dated only after 8 May 2015 means that the presumption is too heavy against Rogelio D. Pacquiao.
(37) It must also be noted that during the time he filed his COC as candidate for Congressman for the Lone District of Sarangani he is still a Barangay Captain of Barangay Apopong in General Santos City.
(38) His continued acts as Apopong Village Chairman would contradict the argument on domicile.
(39) So it is clear that Mr. Ruel Pacquiao has not met the required one-year residency to run for congressman in the district of Sarangani.
(40) It is stressed that Mr. Pacquiao filed his resignation as ABC President and Village Chairman also on October 30, 2015, showing that he is not entitled to be a resident of Sarangani Province only on November 1, 2015.

Motion to Suspend Proclamation

(41) It is also moved that in case RUEL D. PACQUIAO wins as a result of the counting and canvassing of votes his proclamation be suspended if only not to spoil all the official acts that may have been done if only there was no serious issue in the qualification of Ruel D. Pacquiao.
(42) The motion to suspend proclamation becomes more indispensable in case that all the disqualification cases filed to RUEL D. PACQUIAO will not be resolved on or before May 9, 2016 and RUEL D. PACQUIAO garners the majority vote in the said election he should not be proclaimed until the issue on his residency and all other cases against him is resolve.

The Prayer

WHEREFORE, it is respectfully prayed of the Honorable Commission that the instant petition be given due course and be GRANTED.
It is also prayed that the certificate of candidacy of RUEL D. PACQUIAO be cancelled outright having been filed as null and void and as without basis in law.
Other relief just and equitable is also prayed for. 25 April 2016, Manila.

U.N. Security Council condemns NOKOR Submarine Missile Test

UNITED NATIONS (Reuters) – The United Nations Security Council on Sunday condemned North Korea’s submarine-launched ballistic missile test and expressed serious concern that such activities contributed to Pyongyang’s development of nuclear weapons delivery systems.
North Korea (DPRK) said the missile test it conducted on Saturday under the supervision of leader Kim Jong Un had been a “great success” that provided “one more means for powerful nuclear attack.”
“The members of the Security Council agreed that the Security Council would continue to closely monitor the situation and take further significant measures in line with the council’s previously expressed determination,” the council said in a statement.
The submarine-launched ballistic missile test is the latest in a string of recent demonstrations of military might that began in January with Pyongyang’s fourth nuclear test and included the launch of a long-range rocket in February.
The tests have increased tension on the Korean peninsula and angered ally China. In March, the 15-member Security Council imposed harsh new sanctions on North Korea to starve it of money for its nuclear weapons program.
The council called on states to implement sanctions on North Korea, particularly the measures adopted in March.
“The members of the Security Council emphasized that the DPRK’s development and testing of new ballistic missile capabilities, even if launches are failures, is clearly prohibited by these resolutions,” the council said.

Loyal Party Members Urge Xi’s Resignation

Xi Jinping’s efforts to maintain ideological conformity in the Party and the nation have recently met with opposition. After the president emphasized government control of the media with a visit to top state media outlets where he stressed that news must “speak for the Party,” famously outspoken commentator Ren Zhiqiang responded by posting to his Weibo account that state media should first speak for those who fund it: the people (Ren’s comment was answered with a banishment from Chinese social media platforms). After Caixin Media found an article in state censor’s crosshairs for quoting CPPCC delegate Jiang Hong on a lack of freedom to offer unrestrained suggestions at top political meetings, they pushed back with an English article on the original article’s deletion (which too was quickly removed from the Internet). Last week, a Xinhua employee posted an open letter denouncing the increasingly tight media constraints for “triggering tremendous fear and outrage among the public” (the letter, unsurprisingly, didn’t remain online for long).
An even more brazen act of resistance to the control of public and Party opinion was an open letter calling for Xi Jinping’s resignation from all state and Party leadership positions, posted to state-linked Wujie News website on March 4, the day that the annual “Two Sessions” political meetings began in Beijing. Signed by a group of “loyal Party members,” the letter blames Xi for an atmosphere of political, economic, ideological, and cultural anxiety currently sweeping China, and mentions that the “personal safety” of the president and his family could be in jeopardy if he does not comply. Loyal Party Members Urge Xi Jinping to Resign in Open Letter

Hello Comrade Xi Jinping,
We are loyal Communist Party members. On the occasion of the national “Two Sessions,” we write this letter asking you to resign from all Party and state leadership positions. We make this request out of consideration for the Party cause, out of consideration for the nation and its people—and also out of consideration for your personal safety and that of your family.
Comrade Xi Jinping, since your election as General Secretary at the Party’s 18th National Congress, your determination to fight corruption by “beating tigers” has led to some improvement in the unhealthy tendency of internal Party corruption. Your personal leadership on several Central Leading Groups working towards comprehensive reform, as well as the great amount of work you’ve made on economic development, has received some public support, and these efforts have not been unnoticed by us.  
However, Comrade Xi Jinping, we have no choice but to point out that, precisely due to your gathering of all power into your own hands and making decisions directly, we are now facing unprecedented problems and crises in all political, economic, ideological, and cultural spheres.
In the political sphere, your abandonment of important Party tradition, including most significantly the abandonment of the democratic system of the collective leadership of the Standing Committee, instead having all leaders at all levels support your position at the “core,” has resulted in an excessive concentration of power. While strengthening the power of the Party Committees within the NPC, CPPCC, and the State Council, you’ve weakened the independent power of all state organs, including that of Premier Li Keqiang and others. Meanwhile, the stationing of Central Disciplinary Inspection Commission patrols in work units and state-owned enterprises has created a new system of power, leading to a lack of clarity at all levels of government, and confusing the decision-making process.
In the diplomatic sphere, your abandonment of Comrade Deng Xiaoping’s consistent “hide your strength and bide your time” policy, has not only failed to create a favorable international environment, but has allowed North Korea to complete successful nuclear tests, creating an enormous threat to China’s national security; has allowed the United States’ successful return to Asia,  forming a united front with South Korea, Japan, the Philippines, and Southeast Asian countries to jointly contain China. In handling the Hong Kong, Macao, and Taiwan problems, lack of compliance with Comrade Deng Xiaoping’s wise concept of “one country, two systems” has created a further dilemma, allowing the Democratic Progressive Party to win power in Taiwan and letting sentiment of Hong Kong independence to rise. Of particular concern regarding Hong Kong, theirregular manner of bringing booksellers to the mainland has directly injured the “one country, two systems” policy.  
In the economic sphere, as the head of the Leading Group for Financial and Economic Affairs, your direct involvement in the development of micro- and macroeconomic policy has created instability in the stock market and property market, allowing the wealth of hundreds of thousands of ordinary people to vanish. Supply side reforms andproduction capacity policies have resulted in large numbers of layoffs at state-owned firms; and the closing of private firms have also led to many layoffs. The “One Belt, One Road” initiative has put a huge amount of foreign exchange reserves into chaotic countries and regions with no return. The excessive consumption of foreign exchange reserves, and renminbi devaluation cycles, has made everyone’s confidence decline, has brought the national economy to the verge of collapse. People want change.
On the ideological sphere, your emphasis of the “Media’s Party surname,”  hasdisregarded the media’s character of representing the people, and the entire country is stunned; your support of Zhou Xiaoping and Hua Qianfang as representatives on the literary front has left countless literary and art workers in bitter disappointment; your direct condoning of cultural units to sing your praises, and the appointment of your wife Peng Liyuan’s sister as director and producer of the CCTV Spring Festival Gala, hasturned the once popular Gala into your personal propaganda tool. Your condoning this cult of personality, disallowing “improper discussion” of the central government, and “one-voice Party” method, make those of us who experienced the Cultural Revolution unable to not secretly worry—our Party, country, and people cannot bear another decade of calamity!
Comrade Xi Jinping, your carrying out a high-pressure anti-corruption campaign to correct unhealthy tendencies in the Party has had a helpful effect, but, since there are no supporting measures or objectives, it has given rise to an abundance of “slackness” at all levels of government, with officials too afraid to work, discontent openly voiced by the people, and the deterioration of our economy exacerbated. We also see the maingoal of the anti-corruption campaign to be merely a power struggle. We are worried  that this type of inner-Party power struggle may also bring risks to the personal safety of you and your family.
Consequently, Comrade Xi Jinping, we feel that you do not possess the capabilities to lead the Party and the nation into the future, and we believe that you are no longer suitable for the post of General Secretary. For the Party cause, for the long-term peace and stability of the country, and for your own personal safety and that of your family, we ask you to resign from all positions of Party and state leadership, and let the Party Central Committee and the people of the nation select a virtuous leader who can vigorously lead us into the future.

Duterte delivers profanity-free speech; vows to be 'prim and proper' if he becomes president.

Tough-talking Davao City Mayor Rodrigo Duterte on Saturday showed a glimpse of how he will behave if he is elected president.
Speaking to the graduates of the Lyceum of the Philippines (LPU), Duterte was able to make his speech almost profanity-free. 
"If I become President I will be prim and proper," he even promised. 
Duterte then took the chance to explain why he talks the way he does.
He said he is actually taking “the posture of a radical” when speaking in a brutally frank manner. This is to challenge the ruling class and the public officials who seem to only care for the elite.
“Sinasadya ko talaga iyang bunganga ko. I am testing the elite in this country because, historically, we are fundamentally a feudal country,” he said.
"I am testing the waters of radicalism. (I act) as if I am irreverent, (but) it’s not really true. I pray to God always. Baka patayin ako ng dalawang ito," he said referring to rivals former Interior Secretary Mar Roxas and Vice President Jejomar Binay.
Davao City's mayor also took a swipe at Manila-based media. Duterte said he does not have such a bad mouth in reality. He said he just uses foul language because he is fed up with journalists who twist his statements.
"In this country, (the ruling class) wants everything to be prim and proper. They control the media, they control television and all, and they want to do governance in accordance with their interest. That’s how it is. Noon pa ganoon talaga," he said.
"Hindi ako ganoon kabastos, pero sinasadya ko iyon because, you know, mabayaran sila, especially the writers, and there are a lot of them. They would really slant, and every statement I make they would slant. Sinasadya ko tuloy, talagang minumura ko sila," he said.
Minutes before ending his speech, he recalled the hostage-taking incident in Davao City in 1989 involving an Australian missionary that became the subject of his controversial rape remark. Duterte could not stop himself and blurted out a curse word while describing the criminals who killed some of the hostages.
He then apologized for it, saying he put aside his usual vulgarity-laced speeches for that event “in deference to the academic institution.”

Last week I called Bong, the chief of aid of Duterte, to ask him to reinforce Duterte's security because i had received a report of a plot to kill him.

The person who passed me the info appears to be a reliable. I asked him for further proof either in a form of documents or a recording of the secret meeting that apparently was held to work out of the details. He told i would have them to give to give out to the media a few day before the elections.

I don't if this is disinformation from the enemy camp to scare Duterte. But I am not the kind to take him for granted, particularly as election tensions ratches up.

Rivera thanks Pacquiao, celebrates boxer’s colorful career

GENERAL SANTOS CITY (16 April 2016) - "I personally thank you congressman Manny Pacquiao for bringing honor to Gensan and Sarangani."
This was the message of Mayor Ronnel Rivera during the hero’s welcome for Sarangani Congressman Manny Pacquiao at SM City Gensan last Friday (April 15).
Rivera also commented on the boxing career of Pacquiao which comes to an end after his announcement that he will now retire from boxing.
"Pacquiao has been with us for so many years already. He has his ups and downs, but in his last fight, he showed us that he still got it. But whatever he decides, we will respect it," Rivera said. This statement received cheers and loud applause from the public.
Pacquiao already stressed his desire to retire after his third fight against Timothy Bradley. This declaration was further cemented when he told the crowd that he has to do this for his family.
"It is a request of Mommy D (Dionisia Pacquiao), so this time, I think I have to comply," Pacquaio said. His family, especially his wife, Jinkee Pacquiao, has been wooing Manny to put an end to his boxing career for the sake of his children and future.
"I thank you all for the support you have given me especially in my last fight. I know that many of you have been praying for me. I have seen many posts and videos of me in Facebook from people who support me. Thank you so much," an elated Pacquiao said.
"But I think this is the time to retire and focus on giving service to the people. I want to give houses to those who haven't. I want free education, from elementary to college, to those who cannot afford schooling."
"I can remember the time that we are still poor and always hungry. I see that in our people now. I have to give back," Pacquiao affirmed.
Both Pacquiao and Rivera belong to the People's Champ Movement (PCM)--a political party with area of concentration in Sarangani and General Santos City. Rivera is a re-electionist mayor in Gensan while Pacquiao is trying to win a slot in the Senate.
The two of them came together last 2013 elections when they forged a social contract to institutionalize progress in Gensan and Sarangani. When they won their respective races, they kept their promise and made sure that they will be continuing what they have started.
For Rivera, the continuity of positive changes in Gensan is his main mission. There have been several developments in the city such as the street lighting projects and increase in revenues that Rivera wants to foster in the years to come. (RCR Media)

The above are just some of Aquino’s wonderful achievements. I am sure. Given time. This list would continue to blossom. But as of this writing, the man does have 9 months to go. Who knows what he can come up with in that time?

Napoles, Lañete granted bail from plunder over pork barrel scam.

The Sandiganbayan Fourth Division has granted the bail of accused mastermind Janet Lim-Napoles and dismissed Masbate governor Rizalina Seachon-Lañete from plunder over the pork barrel scam.
Although being granted bail, Napoles cannot be released from detention because her bail had been denied in other divisions hearing the plunder case.


She is also serving life sentence for the serious illegal detention of whistleblower Benhur Luy.

The court granted the bail of dismissed Masbate governor Lañete from plunder, initially a non-bailable offense, confirmed Atty. Laurence Arroyo.
She is set to pay her bail today, he added.
Lañete was the first lawmaker embroiled in the pork barrel scam granted bail by the Sandiganbayan. Meanwhile, Sen. Juan Ponce Enrile was allowed to post bail by the Supreme Court due to humanitarian reasons.

According to the court decision promulgated Tuesday, the prosecution failed to prove that Lañete received from Napoles the threshold P50 million kickbacks to constitute plunder.
The court said the prosecution even admitted that Napoles and Lañete never met personally, and that Lañete never attended the parties or sponsored Masses, or visited the office of Napoles.
The prosecution had also admitted that Lañete and Napoles never met personally to discuss the percentage of kickbacks.
Witness Luy had also said that he handed the kickbacks not to Napoles but to Lañete’s chief of staff Jose Sumalpong, who is at large for plunder.
The court said there were some instances that Lañete’s projects with Napoles were not “ghost projects” after all.
“Luy himself claims that accused Lañete once talked to him over the phone, asking that the vests to be delivered in her favorite color orange. This shows that there was indeed a delivery of items,” the court said.
Lañete is accused of pocketing P108.405 million allegedly siphoned from her Priority Development Assistance Funds (PDAF) from 2004 to 2010.
She is detained at the female dormitory of Camp Bagong Diwa in Taguig.

In its complaint, the Ombudsman said Lañete when she was Masbate representative misused P112.29 million of PDAF from 2007 to 2009.
Based on whistleblower Benhur Luy’s ledger, Lañete from 2004 to 2010 received P108.405 million in kickbacks, of which P73.065 million were siphoned from Lañete’s PDAF from 2007 to 2009.
In its indictment, the Ombudsman said “Lañete continuously endorsed the implementation of her PDAF-funded livelihood and agricultural projects to questionable NGOs associated with or controlled by Napoles.”
“(Lañete’s) P112.29 million PDAF was anomalously used for livelihood projects, financial assistance to farmers, farm inputs and farm implements, skills training and distribution of livelihood kits in nail care, wellness, massage and candle- making.  Several Memoranda of Agreement (MOA) were entered into between Lañete, Technology Resource Center, National Agribusiness Corp and the NGO-partners,” the Ombudsman said.
Lañete is part of the first batch of lawmakers charged for purportedly pillaging public funds in ghost projects for kickbacks in connivance with accused pork barrel scam mastermind Janet Lim-Napoles.
APEC Rep. Edgar Valdez also faces plunder for allegedly raking in P57.787 million in kickbacks.  Valdez is detained at Camp Bagong Diwa with his bail plea denied.
Meanwhile, facing malversation raps are former Agusan Del Sur. Rep. Rodolfo Plaza, Benguet Rep. Samuel Dangwa, and Cagayan De Oro Rep. Constantino Jaraula.
The antigraft court is also hearing the plunder cases of detained senators Ramon Revilla Jr., Jose “Jinggoy” Estrada and Juan Ponce Enrile.

Abu Sayyaf fatalities up to 24

THE FATALITIES on the Abu Sayyaf side rose overnight, but their leaders remain alive, with one of them “critically wounded.”

This is the latest update on the continuing clashes between the Armed Forces and the extremist Abu Sayyaf Group (ASG), which broke out over the weekend in Tipo-Tipo, Basilan, and took the lives of 18 soldiers and left more than 50 wounded.

In a press briefing at Camp Aguinaldo Tuesday, AFP spokesperson Brig. Gen. Restituto Padilla confirmed that 24 ASG members have already been killed in the clashes—a significant increase from the 13 reported on Monday.


The government casualty count remains the same, said Padilla, and the six soldiers reported “critically wounded” are already in stable condition.

Padilla reported no significant engagements since the weekend. He said the military has started utilizing “artillery fire in known ASG positions” in the clash sites.

He attributed the increased fatality count in the Abu Sayyaf to its fighters succumbing to the wounds and injuries that they sustained in the initial encounter with government troops on Saturday and Sunday.

However, the number of bodies retrieved by the military since Saturday has remained at only two—including that of Moroccan terrorist Mohammad Khattab. The other body has yet to be identified.
At noon Tuesday, the military initially reported 25 killed on the Abu Sayyaf side, including Furuji Indama, known as the right-hand man of ASG leader Isnilon Hapilon.

Padilla clarified two hours later that Indama was only “critically wounded,” based on reports from the ground.
It was a near-hit for a high-value target. Defense Secretary Voltaire Gazmin said Indama’s “neutralization” was important to “weaken threats.”

Padilla said Indama was Hapilon’s “trusted lieutenant,” and the leader of various ASG subgroups.
However, in an interview with the media on the sidelines of the turnover of new aircraft at the Air Force headquarters at Villamor Airbase Tuesday, Gazmin said the bigger accomplishment was the earlier confirmation of the killing of bomb-maker Khattab.

“We lessened the risk of transferring the technology to make bombs. [In fact], he was wearing a vest lined with explosives [when his body was retrieved],” Gazmin said in Filipino.

“Our heroes sacrificed 18 lives in exchange for the safety of a larger number of civilians,” Padilla said.

Gazmin confirmed reports that Khattab was in the country “to unify all the terrorist groups here and link them with the international terrorist network.”

He did not confirm if Khattab was part of the terrorist Islamic State (IS). Padilla said Khattab’s possible IS link was still being “validated.”

“We recovered a lot of data and material we can study closely, from which we can glean the linkages,” Padilla said.

“We don’t deny there are sympathizers or groups here inspired by IS who pledged allegiance. But still, we are looking for stronger evidence and data saying they are receiving [instructions] and are linked directly to Daesh,” he said.

Meanwhile, Gazmin said that after ceremonies in Zamboanga last Sunday, most of the slain soldiers were sent to their  “home bases” and families, mostly around Mindanao, and that they would be receiving honors in their respective areas.

Padilla added that the benefits for the soldiers’ surviving families were being “fast-tracked.”
Gazmin said that rumors that information had been led to the ASG—leading to the high number of soldiers killed—would be looked into.

But he dismissed allegations that prior coordination with the secessionist Moro Islamic Liberation Front (MILF), with which the government signed a peace agreement, led to the possible leak. “It’s part of the mechanism. As many as 3,000 marchers from almost all 50 states, some of whom came on foot over 10 days from Philadelphia’s Liberty Hall, staged sit-in demonstrations at the US Capitol Monday, protesting the failure of Congress to restrict big money in politics and protect voting rights. They will be back today, joined by dozens of older Americans who are willing to risk arrest to get the attention of legislators and demand a more democratic future for their children and grandchildren.
U.S. Capitol Police yesterday said they arrested and processed more than 400 demonstrators yesterday, with more being processed into the night and some not being released until this morning. Outnumbered, police were slow to move in and make arrests and then could only process a few of the demonstrators at a time. They called the number of non-violent demonstrators “unprecedented.” Protesters’ spirits were high and there were no incidents.

Thousands of Americans protesting in the US Capitol for voting rights and to get the billionaire dollars out of our politics is the stuff of Republican nightmares. The success of the Bernie Sanders presidential campaign has demonstrated that millions of Americans aren’t being fooled.
The American people have seen the behavior of a Republican controlled Congress that has openly ignored the will of the majority of the country while doing the bidding of their billionaire donors.
What thousands of people are protesting in Washington, D.C. is a two-pronged Republican attack on democracy. Conservatives are trying to make the electorate smaller through voter suppression while at the same time allowing billionaires to buy the federal government through Citizens United dark money.
Our elder Americans have seen the theft of voting rights before, which is why they are joining the fight to stop history from repeating itself. “I’m doing this because I care enough about the kind of country we’re leaving for them. I want them to have a chance to have a full say in it,” said Lynne Iser, an activist from Philadelphia who participated in anti-war and civil rights protests in her youth and is now coordinating Elders Standing for Democracy Spring.
The issue of voting right cuts across all demographic lines. Thousands of Americans have walked to the Capitol and are telling Republicans that they know what is going on and they aren’t going to let billionaires and Republican politicians steal the government.


Ex-MRT chief Vitangcol indicted for $30M extort try.

The Ombudsman has indicted former Metro Rail Transit (MRT-3) general manager Al Vitangcol for two counts of graft over the alleged extortion try on Czech firm Inekon in exchange for contracts with the railway system.
In a statement on Monday, Ombudsman Conchita Carpio Morales said she has ordered the filing of graft charges or violations of Section 3(b) of the Anti-Graft and Corrupt Practices Act against Vitangcol, who was earlier sacked at the height of the extort try scandal, as well as his purported envoy businessman Wilson De Vera.
During the 2013 midterm elections, De Vera was a mayoral candidate in Pangasinan under the Liberal Party but he lost.



The Ombudsman said Vitangcol’s first graft charge stemmed from allegations that he attempted to extort $30 million from Inekon in exchange for contracts for the supply for additional light rail vehicles and maintenance of the MRT-3 in connection with the P3.7 billion MRT-3 expansion project in 2012.
Ombudsman investigation showed that Vitangcol sent his envoy De Vera to demand the payment of $30 million, later reduced to $2.5 million, for the Inekon to be awarded the contract.


Vitangcol and De Vera were accused of extorting $30 million from Inekon Group CEO and chair Josef Husek at the residence of then Czech Ambassador to the Philippines Josef Rychtar in exchange for granting Inekon the P3.7-billion contract to supply 48 coaches for the MRT 3 expansion. The money was later reduced to $2.5 million.
Inekon turned down the extort try.
Meanwhile, Vitangcol and De Vera’s second graft charge stemmed from the allegation that they conspired and insisted for Inekon to sign a joint venture agreement for the maintenance contract under a 60-40 percent sharing scheme with a group of persons which included De Vera, an incorporator of the firm Philippine Trans Rail Management and Services Corp. (PH-Trams).
After weighing in the testimonies by Rychtar and Husek, as well as the conflicting statements by Vitangcol and De Vera, Ombudsman Morales said the “totality of x x x circumstances, taken together with the affirmative declarations of complainant’s witnesses” would show that Vitangcol attempted to extort Inekon in exchange for the contract.


The Ombudsman also found Vitangcol guilty of the administrative offenses of Grave Misconduct, Serious Dishonesty and Unlawful Solicitation, and was ordered dismissed from service and perpetually barred from government with his retirement benefits forfeited.
Due to Vitangcol’s separation from the service, the penalty of dismissal is convertible to a fine equivalent to respondent’s one year salary.
In his affidavit submitted to the House of Representatives which investigated the alleged extort try, Husek said he and Rychtar met De Vera in July 2012 when De Vera proposed that Inekon pay $30 million for the company to be selected the supplier of MRT coaches.
When Inekon turned down the offer, De Vera returned and proposed instead a 60-40 joint venture between Inekon and a group of incorporators selected by Vitangcol for the maintenance contract of the MRT.
The MRT maintenance contract with Sumitomo was then set to expire in Oct. 2012.
The maintenance contract was later awarded without public bidding to PH Trams-CB&T, a graft-ridden contract which gave Vitangcol his first graft case.
Meanwhile, the Department of Transportation and Communications bid out the contract for the 48 new coaches and awarded it to China’s CNR Dalian Locomotive & Rolling Stock.
Vitangcol is facing graft before the Ombudsman for irregularly awarding without public bidding the MRT-3 maintenance contract to PH Trams-CB&T joint venture where his uncle-in-law Arturo Soriano is an incorporator.
Vitangcol had decried selective justice, adding that the Ombudsman cleared from the charges Transportation Secretary Jun Abaya even though he approved the anomalous contract to PH Trams.
Vitangcol was sacked by the Department of Transportation and Communications on Aug. 2014 after he was accused of conflict of interest when he awarded a contract to the firm of his wife’s uncle. JE
